Federal ruling is eighth straight victory for Chimney Safety Institute of America in protecting trademark from unauthorized use INDIANAPOLIS - The United States District Court for the Northern District of New York has issued an Injunction and Order on behalf of the Chimney Safety Institute of America® (CSIA) against Central Masonry & Chimney, Inc., its owners, and any business entity performing chimney cleaning in which they have an ownership interest or control. The order comes after CSIA brought legal action against Central Masonry for repeated unauthorized use of CSIA's registered trademarks, including the CSIA Certified Chimney Sweep® mark, on websites and other marketing materials. "With as hard as sweeps around the country work to earn the CSIA Certified Chimney Sweep credential, we feel a strong obligation to protect their credibility and the value of their certification by enforcing proper use of our trademarks," says CSIA Executive Director, Frances Kelly. “We hope our undefeated track record in federal court will be a deterrent to others who may consider similar fraudulent actions.” Per the settlement agreement, the Defendants were required to pay CSIA an undisclosed sum and are prohibited from using CSIA's certification mark or service mark, or otherwise referencing certification by CSIA in conjunction with their current or future chimney sweeping businesses, unless authorized by CSIA.
